Anyone who accesses the Optima website, shall undertake to respect the present conditions of use, which may, for some services, be supplemented by special conditions.
All individuals are responsible for the data that they distribute, use and/or transfer and in this respect shall undertake to respect the French regulations in force, notably those relating to clearly illegal content or to the protection of third-party rights, and more particularly, to the protection of intellectual property.
The Consortium is not responsible for the use of any data or content distributed or services provided by another person, who, notably, does not respect the regulations in force.
Furthermore, The Consortium may, at its discretion, review the website and make changes to it or delete it at any moment without prior communication.
Intellectual property is understood to mean any trade marks and designs, patents and copyrights (notably information, photographs, audio and video, images, graphics, links, site architecture and software).
The data present on the website notably includes trade marks, designs, logos and content protected by intellectual property for which The Consortium have acquired the rights.
Unless The Consortium provides its written approval, the full or partial distribution, reproduction or representation of this data for any purpose other than for private use on any media whatsoever is prohibited and may result in the person failing to respect this prohibition being held civilly and criminally liable.
PROTECTION OF PERSONAL DATA
The information collected via the website shall be used exclusively by The Consortium. In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, you have a right to access, rectify, modify and erase your personal data. The Consortium shall undertake to respect and apply the rules relating to the protection of natural persons’ personal data in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
The Consortium shall therefore undertake to take all the precautions necessary to preserve the security and confidentiality of the information it receives.
The Consortium shall undertake to use and store the personal data recorded on the system for the sole and exclusive purpose of processing applications. Should The Consortium call upon third parties to process the data, in the name and on behalf of The Consortium, these third parties shall make a commitment to The Consortium by signing the contractual clauses related to the protection of personal data. We collect the following personal data:

The Consortium shall undertake to store this personal data for a limited duration proportional to the purpose for which it is collected.
Your personal data shall therefore only be stored for a maximum of 2 years from the date on which we last have contact with you.

SCOPE OF RIGHTS GRANTED
The Consortium grants you a personal, non-exclusive, non-transferable and non-assignable right to access and use the Optima Website. All other rights are expressly excluded, unless stipulated otherwise in a specific written agreement. The information contained in Optima Website is provided by the Consortium and may be used for information purposes only.
Consequently, and without limitation, the user shall undertake to refrain from using the Optima Website and the content thereof for purposes other than those outlined in the present conditions of use; from reproducing, representing, adapting, modifying, manipulating, translating and/or exporting, and merging with other IT applications, either permanently or temporarily, by any means and in any form, in any way whatsoever, all or part of the Optima Website and/or its related content; from extracting all or part of the Optima Website and/or the content thereof by any means and in any form, in any way whatsoever; from integrating all or part of the Optima Website and the content thereof into another product; from creating works derived from the Optima Website and the content thereof; from removing, concealing or altering any property notices, labels, legal notices or trademark or copyright notices displayed on or within the pages of the Optima Website and/or its related content, and from authorising a third party to do any of the above.

The Consortium expressly reserves the right to correct, or have someone else correct, any anomalies present on the Optima Website or in the content thereof insofar as is necessary to ensure that use of the Optima Website is compliant with its intended purpose.
To the fullest extent permitted by applicable legislation, the limitations and exclusions of liability provided for in the present notice shall apply, whatever the basis for liability.
The Optima website and the content thereof are accessible on an “as is” and “as available” basis. The Consortium shall not provide any guarantee, either express or tacit, by law or by agreement, including, without limitation, (i) that this website and its content shall meet your requirements, (ii) that this website shall be uninterrupted, timely, secure or error-free, (iii) that any results displayed on the Optima website are accurate, up to date or reliable, (iv) that the quality of the data, information or other content obtained will respond to your expectations or that this data or information or any other documents will be faultless or error-free, or that any possible faults will be corrected. Access and use of the Optima website is therefore at your own risk.
Under no circumstances shall The Consortium or its potential successors or transferees be held liable towards a user, including in the event of a third party claim, for any claims or costs related to any any direct or indirect damage resulting from the use of the website, notably but not limited to those arising from or related to access to, use of or unavailability of the Optima website or the content presented on it or accessible via it, to inability to access and/or use the website, or to the maintenance thereof, including the loss of data or programs, loss of use, financial loss, any form of deterioration or infection by a virus on your computer equipment (including, but not limited to software, hardware, connections and any system or network), and loss of earnings, business or profits.
You agree to indemnify, defend and hold The Consortium harmless against any claims, liabilities, losses, costs or expenses incurred in relation to the violation of the present conditions of use or resulting from or in relation to your use of or access to the Optima website.
